Terms of Service

These terms govern your use of lavishens.co and any purchase you make from it. By placing an order you agree to them. Please read them alongside our Privacy Policy, Shipping Policy and Return and Refund Policy, which form part of these terms.

Who we are

Lavishens is a homeware retailer trading from Coleford, Gloucestershire, United Kingdom. You can reach us at sales@lavishens.com.

Eligibility

You must be at least 18 years old and legally able to enter into a contract to buy from this site.

Orders and acceptance

Placing an order is an offer to buy. Our confirmation email acknowledges that we have received your order; it does not by itself form a contract. The contract is formed when we dispatch the goods.

We may decline or cancel an order where the item is unavailable, where there has been a pricing or description error, where we cannot obtain payment authorisation, or where we reasonably suspect fraud. If we cancel an order you have paid for, we refund you in full.

Prices

Prices are in pounds sterling and include UK VAT where applicable. Delivery is free on all orders. Prices may change at any time, but changes will not affect orders we have already accepted.

Where an item is listed at an obviously incorrect price, we are not obliged to supply it at that price and will contact you before dispatch. See our Payment Policy.

Product descriptions and images

We describe our products as accurately as we can. Photographs are illustrative: colours vary between screens, and natural materials such as wood, stone, rattan and glass differ slightly from piece to piece. Such variation is inherent to the material and is not a defect. Dimensions given are approximate and subject to normal manufacturing tolerance.

Some product imagery is styled or digitally composed to show an item in a room setting. The product itself is shown accurately in shape, colour, material and proportion; the surrounding setting is illustrative.

Delivery

We dispatch within 1 to 2 business days and delivery takes 5 to 15 business days depending on destination. These are estimates, not guarantees. Risk in the goods passes to you on delivery. Full terms are in our Shipping Policy.

Returns and cancellation

You may return most items within 30 days under our Return and Refund Policy, and you have a separate statutory right to cancel within 14 days set out on our Right of Withdrawal page. Nothing in these terms affects your statutory rights.

Your account

If you create an account you are responsible for keeping your password confidential and for activity carried out under it. Tell us promptly if you believe it has been used without your permission.

Acceptable use

You may not use this site for any unlawful purpose, attempt to gain unauthorised access to it, interfere with its operation, scrape or copy its content systematically, or transmit malicious code. We may suspend access where we reasonably believe any of these has occurred.

Intellectual property

All content on this site, including text, product photography, styled imagery, page design and the Lavishens name and branding, belongs to us or our licensors and is protected by copyright and trade mark law. You may view and print pages for your own personal use. You may not reproduce, republish or use them commercially without our written permission.

Reviews and submissions

If you submit a review or other content, you grant us a non-exclusive, royalty-free licence to use it in connection with the shop. You confirm the content is your own and is not unlawful, offensive or misleading. We may remove any submission at our discretion.

Liability

We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded, including your rights under the Consumer Rights Act 2015.

Subject to that, we are not liable for losses that were not foreseeable to both parties when the contract was formed, or for losses arising from your use of an item for a purpose it was not intended for. Where we are liable, our liability is limited to the price you paid for the goods concerned.

These terms do not affect your statutory rights as a consumer.

Events outside our control

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including carrier disruption, customs delays, extreme weather, industrial action and failures of public telecommunications networks. Where such an event occurs we will contact you, and you may cancel for a full refund if the delay is substantial.

Third-party links

Where this site links to other websites, those sites are outside our control and we accept no responsibility for their content or their handling of your data.

Changes to these terms

We may revise these terms from time to time. The version that applies to your order is the one published when you placed it.

Governing law

These terms are governed by the law of England and Wales, and disputes are subject to the non-exclusive jurisdiction of the courts of England and Wales. If you live elsewhere in the UK or in the EU, you keep the benefit of any mandatory consumer protections of your own country.
